That’s What, Inc. is a public benefit corporation. As per our certificate of incorporation in the state of Delaware, our purpose is to “balance social benefit with profit in developing social networking software that promotes non-addictive use patterns and destigmatizes payment transparency in order to prioritize user experience over shareholder value.” Balancing social benefit with profit, for us, means that we want to create apps that are not engineered with the intention of keeping our users addicted to their phones. While we still want to make some money with TWIBS, we feel that whatever money we make shouldn’t be at the expense of the user experience. This mentality applies to both the design of the app and our use of your data across the app. We believe that payment-transparency should be destigmatized and we want to do our best to create a product that helps you meet the people you want to meet.
By creating an account you agree that:
-You are at least 18 years of age
-You are not a person who is banned from using dating apps
-You have never been convicted of a sex crime
You are responsible for keeping your login credentials confidential and for the activities that happen using your account. If someone has gained access to your account you should immediately contact us.
If you need to delete your account you can do so by going to the settings within the app. If you are subscribed to the service and need to avoid additional billing then you have to do that through the Settings of your payment account within the Apple App Store or the Google Play Store.
You are solely responsible for all your interactions with other users on TWIBS. You accept that there is an inherent risk to using an application that encourages strangers to connect online. Despite the fact that we do our best to keep our community respectful, we cannot guarantee the behavior of all our users. We do not conduct criminal background checks and we make no warranties as to how our users will generally behave. If you decide to meet with someone in person, TWIBS is not responsible for the conduct of that user. You should never provide financial information or send money to other members and accept that you are responsible for your actions on the app.
You are given the right to use TWIBS so long as you agree to the following conditions:
-You will not use malicious software or try to mine any kind of data without consent
-You will not use other user’s information without their consent for commercial reasons
-You will not try to modify the intended use of the application in any way
By creating an account you agree to grant us the following right:
-You agree that any content that you put up on the website can be freely viewed by anyone who uses the service
-You agree to let us send you DMCA Takedown Notices if you infringe on the rights of other members or third parties
-You agree that the information you supply when you create your account is truthful
-You agree to let us monitor and delete any content that you post through the app
-You agree to be respectful when you contact us
-You agree to let us disclose your information to the authorities if we are required to do so
If you violate any of the following rules or behave in a way that we deem inappropriate or unlawful, whether on or off the app, we reserve the right to investigate and terminate your account with no refund:
-Do not do anything illegal
-Do not do anything nefarious
-Do not do anything to damage TWIBS
-Do not try to defraud other members
-Do not impersonate anyone without their permission
-Do not stalk, harass, disrespect, abuse, or mistreat any person
-Do not violate copyright or trademark rights
-Do not post hate speech
-Do not post pornographic content
-Do not create a new account if you deleted your account
While we do our best to moderate the content on the app, we cannot guarantee or be held responsible for the content that members post. Any content that violates the above rules or any part of this agreement should be reported through our contact form or by directly reporting a user within the app.
Any purchase made through TWIBS is final-sale and non-refundable. You agree that we do not have any obligation to reimburse you in any case whatsoever. If we decide to make an exception for a refund or a subscription issue, we will apply the laws applicable to refunds through your local jurisdiction. Members located in the EU are entitled to a full refund during the 14 days after the subscription starts. If you choose to buy something through TWIBS directly or through the Apple App Store or the Google Play Store, you will be charged for the price as well as any taxes imposed on your payment. You authorize us to charge you for the product or service that you purchase. If you subscribe and elect to auto-renew your subscription, you agree to be billed until you cancel that subscription. You agree to let us store the necessary information to automate recurring charges for a particular service that you have purchased. If you have any issues you can contact us and provide more information about a charge that you consider incorrect. If you purchase a product by accident or do not turn off your subscription, please note that you are still legally obligated to pay outstanding amounts. Deleting the app from your phone does not terminate your subscriptions. You agree to take sole responsibility to manage your account and subscription. You will always be able to edit any payment settings that you have entered through the settings in the app. If any payment is not successful due to insufficient funds or expiration you agree to let us continue billing you for a subscription. You may be able to purchase virtual currency through TWIBS (“points” or “coins” or a similar term). You agree that any purchase of this virtual currency is non-refundable and non-exchangeable and does not actually translate to real-world currency. If you are located in the Republic of Korea you are entitled to a full refund of your subscription or of unused virtual currency within 7 days of purchase. Please note that refunds made using an Apple ID are handled by Apple, not by TWIBS. To request a refund go to the App Store, click on your Apple ID, select "Purchase history", and tap "Report Problem" for that transaction. You can also go to https://getsupport.apple.com. If you purchased something through us directly or through the Google Play Store please contact us with your order number. You can also deliver a notice that you are canceling this agreement to the address for That’s What, Inc. If you invoke your cancellation rights we will refund (or ask Google to refund) payments received from you within 14 days, except for purchases made through your Apple ID which are controlled by Apple.
If you believe that any information on TWIBS constitutes copyright infringement please contact us to take down the infringing materials. You agree to include all the following information when you contact us:
-A description of where we can find the copyrighted materials within the app
-A description of the way in which the materials constitute copyright infringement
-Your contact information including phone and address
-A written statement that you are acting in good faith
-A digital or physical signature
We provide the services in the app on a completely “as is” basis and we do not grant any kind of warranty as to the quality of the service. There should be no implied warranties as to the security or defectiveness of the service and any information that you obtain through the service will not necessarily be accurate. We cannot guarantee that our servers will always provide correct information and if you find a bug you should consider it a feature. We are not responsible for any content that any member or third party posts regarding TWIBS and we take no responsibility or anything that is sent or received through the service. Use the app at your own risk.
If you encounter advertisements or promotions, any links that you click on are not our responsibility in any way shape or form. Any interactions you make with third parties are solely governed by the terms and conditions that describe your relationship with those parties. We are not responsible for third-party actions.
TWIBS employees, affiliates, licensors, or service providers will, to the fullest extent permitted by law, not be liable for any damages, in the most general sense, including loss of data or loss of profits or any other tangible loss. Any circumstance that results from your access to use or your inability to use the service, from any interaction with a third party or a user of the service, or from any kind of alteration of your content, even if we have been advised of the damages.
Unless you reside in the EU, you give up your right to go to court or assert any claims between you and our company by participating in this service. You also give up the right to participate in a class action lawsuit against us and any claims you make against us will be determined by a neutral arbitrator, rather than a judge or a jury.
You agree to indemnify us completely against any kind of complaint, demand, claim, damages, losses, or any other kind of liability, that results from your use of the service, the content you post through the service, or a breach of these terms and conditions.
